    NOTICE OF THE INTENTION TO REVIEW THE CLONMEL & ENVIRONS DEVELOPMENT PLAN 2008 & TO PREPARE A NEW DEVELOPMENT PLAN FOR THE AREA

    Notice is herby given pursuant to Section 11 of the Planning and Development Acts 2000-2010 that Clonmel Borough Council and South Tipperary County Council, being the authorities for the area, intend to review the existing Clonmel and Environs Development Plan 2008 and to prepare a new development plan for the area.

    Submissions or observations regarding objectives and policies to deliver an overall strategy for the proper planning and sustainable development of the area of the development plan may be made in writing within the time period specified below. Children, or groups or associations representing the interests of children, are entitled to make submissions or observations. The Planning Authorities intend to review the zoning of the area of the development plan for the purposes of developing the objectives and policies to deliver and overall strategy for the proper planning and sustainable development of the area of the development plan, and the core strategy and shall take account of the statutory obligations of any local authority in the area and any relevant policies or objectives for the time being of the Government or of any Minister of the Government. However in accordance with the Planning and Development Acts 2000 – 2010 requests or proposals for zoning of particular land for any purpose shall not be considered at this stage.

    Strategic Environmental Assessment & Appropriate Assessment

    In complying with SEA Directive [2001/42/EC], the Planning and Development Regulations 2001 – 2010 the planning authorities propose to carry out an environmental assessment as part of the review of the existing development plan and the preparation of a new development plan, and for this purpose, the planning authority will prepare an environmental report of the likely significant effects on the environment of implementing the new plan, and the provisions of articles 13C to 13J shall apply.

    In complying with Article 6 of the EU Habitats Directive (Directive 92/43/EEC) and Section 177T of the Planning and Development Acts 2000 – 2010 Clonmel Borough Council and South Tipperary County Council have determined that an Appropriate Assessment is also required for the review of the Plan and a Natura Impact Report will be prepared in relation to the Draft Plan.

    A copy of the Two Year Progress Report on the existing Development Plan, the Issues Paper and Background Document regarding the preparation of the new development plan will be available for public inspection at the offices of Clonmel Borough Council, Town Hall, Clonmel and at the Planning Section, South Tipperary Town Council, County Hall, Emmet Street, Clonmel and submissions or observations are invited from Monday to Friday between the hours of 9a.m. to 1p.m. and 2 p.m. to 5 p.m. from 9th December 2011 to 13th February 2012 (both dates inclusive).
